Jevic Transportation accused of failing to give sufficient notice of layoffs

A lawsuit, seeking class action status, has been filed against Jevic Transportation, alleging violation of the federal Worker Adjustment and Retraining Notification Act (WARN) requiring businesses with 100 or more employees to provide at least 60 days notice of plant closings or mass layoffs. Jevic Transportation, who recently discontinued operations and filed for Chapter 11 bankruptcy, had laid off approximately 1,200 employees, of which about 1000 are truck drivers, allegedly without proper notification. The lawsuit, filed in Delaware federal court, is seeking WARN Act-required wages, salary, commissions, bonuses, accrued holiday and vacation pay, pension and 401(k) contributions and other benefits that would have been paid or covered during the notice period.
