A lawsuit has been filed and is seeking class action status against Microsoft for allegedly failing to provide adequate access and service to Xbox Live and its subscribers. The lawsuit was filed in the US District Court in Texas on behalf of gamers affected by Xbox Live problems in December 2007. The suit alleges breach of contract, breach of warranty, and negligent misrepresentation.

In December 2007, Xbox Live crashed and prevented video game players around the world from accessing play for several weeks. Xbox Live is Microsoft's gaming membership that provides gamers with access Microsoft's servers for online gaming. Over eight million gamers worldwide subscribe to Xbox Live.

Microsoft offered subscribers a free arcade download as an apology. However, Xbox Live continues to deny subscribers access and has even issued apologies for their failure to correct server problems.
