City of Independence awards two former employees a $65,000 age bias settlement.

Independence, MO: (Feb-28-08) Two employees brought a federal age discrimination lawsuit against the city of Independence, alleging that they were discriminated against because of their age. The two filed a complaint with the US Equal Employment Opportunity Commission (EEOC), who filed the lawsuit on their behalf. The suit claimed that the city discriminated against older workers by barring them from accepting donated leave from fellow employees. Sources stated that the two workers suffered from health conditions that prevented them from working. Each sought to receive leave donated by other employees, but the city denied their requests, forcing them to retire.

Sources close to the case revealed that the parties had reached a settlement, in which the city of Independence has agreed to pay $65,000 to the two men, resolving their federal age discrimination lawsuit. Additionally, apart from the monetary payout, the city must change its leave policy, provide training to managers and supervisors, report to the EEOC about employees seeking leave under the new policy and post a notice about the settlement.
