Election Systems and Software agrees to pays city of San Francisco $3.5 million settlement after problems with AutoMARK lead to prolonged hand counting of votes.

San Francisco, CA: (Jan-22-08) The city of San Francisco brought a lawsuit against Omaha-based Election Systems and Software (ES&S), over costs the city incurred in meeting new state certification requirements for the company's AutoMARK ballot marking devices. The suit claimed that problems with the ES&S machines resulted in prolonged hand counts of votes in the Nov. 6, 2007 election. Elections officials were not able to certify the results until Dec. 7, 2007. Sources close to the case stated that as part of a settlement reached, Election Systems and Software agreed to pay the city $3.5 million in return for the devices, and the lawsuit will be dismissed. Sources stated that as part of the agreement, ES&S does not admit any liability. Further, the city has agreed to reimburse ES&S for any outstanding invoices for voting supplies and services.
