A class action lawsuit has been filed against the company for falsely claiming Activia and DanActive probiotic yogurt products have clinically and scientifically proven health benefits. The lawsuit was filed in the Central District of California and alleges Dannon Company’s advertisements and labels for Activia falsely claim the yogurt is proven to improve one’s intestinal rhythm and regulate one’s digestive system. Similarly, Dannon’s DanActive incorrectly states it has been clinically proven to help naturally strengthen the body’s defenses and to improve the body’s immune system.

The Dannon Company, Inc. has sold hundreds of millions of dollars worth of yogurt in recent years due to its claims of providing health benefits not available in other yogurts. The class action claims Dannon knew numerous scientific studies failed to support the health benefits touted in its own ads.

The class action lawsuit was filed on behalf of tens of thousand of consumers who paid premium prices for the products believing they had enhanced benefits. The suit seeks redress for consumers who purchased the products based on the bogus claims, and asks Dannon to replace the misleading marketing with honest labels and ads.
