A federal RICO class action lawsuit has been filed against the attorney and his New Jersey associates alleging fraudulent operations in offering expertise in same gender couples' issues. The lawsuit was filed in the District Court of New Jersey, Docket 1:08-cv-01212, and claims Stephen J. Hyland was involved in unethical legal practices that victimized public confidence in legal services. It claims Hyland defrauded the public, State Bar, and Judiciary by deceptive advertising about a case he never won and a legal decision that never happened.The lawsuit alleges Hyland's January 30, 2008 press release e-mailed to major media outlets, that republished it in print and on the web, falsely stated information regarding a New Jersey woman allegedly awarded equitable distribution in a domestic partnership termination. Contrary to the press release, on January 15, 2008, Gloucester County Family Court Judge Tomasello actually denied Hyland's request for equitable distribution. The class action claims Hyland sent out the press release to try and build a false reputation by targeting the gay community.
The RICO lawsuit seeks to stop deceptive and fraudulent business practices, ban Hyland from operating a law office, and make full restitution to injured consumers who have been defrauded by false claims of the decision that never happened.
