Frankfort, KY: (Apr-24-08) Sarah Missy McCray, a former Transportation Cabinet worker, brought a wrongful termination lawsuit against the Transportation Cabinet in 2005, alleging that she was retaliated against for blowing the whistle in the merit system scandal during former Gov. Ernie Fletcher's administration. The suit claimed that McCray was retaliated against for cooperating with the attorney general's investigation of hiring practices during former Gov. Fletcher's administration. In her suit, she claimed that former Transportation Secretary Bill Nighbert retaliated against her for testifying before a Franklin County grand jury that was involved in the investigation. He was accused of refusing to approve a job performance bonus recommended by her supervisor and calling McCray a "she-devil."

Sources familiar with the negotiations stated that the two sides had reached a settlement agreement, in which the state of Kentucky agreed to pay McCray $500,000 and offer her a new state job. The four-page settlement agreement released by the cabinet announced that McCray will receive a lump sum payment of $500,000 and a job in the Personnel Cabinet that pays $62,500.
