International Law

Freedom to Differ Freedom to Differ

A blog that speaks freely about legal issues facing the media and the internet. It mainly covers issues relating to the legal regulation of the internet and the media, but at times Constitutional law issues and politics are discussed. While the focus is on Australia, developments in other nations around the world are considered as well.

"Where Are All The Gay Judges?"

Posted on February 20, 2010
As The Awl points out, while it may be interesting (if irrelevant) that the judge ruling on the Prop. 8 trial, Vaughn Walker, is gay, it is more remarkable that Walker is apparently just one of two homosexual federal judges in the U.S. The Awl: Out of more than 1,000 federal judges in the country, there are only two that are known to be gay: Vaughn, and a federal trial court judge in Manhattan, Deborah Batts...

"Why Shouldn't Jurors Be Able To Use Technology To Do More Research?"

Posted on February 09, 2010
We've pointed out in the past that, eventually, the judicial system is going to have to come to terms with the fact that people use technology to research and communicate, rather than trying to pretend it can be stopped. But, it sounds like that's going to take a while...

"Out But Not An Issue: Judge In Prop 8 Trial Is Gay"

Posted on February 08, 2010
It was apparently the most open secret of the Prop 8 trial in San Francisco. The presiding judge, Chief U.S. District Judge Vaughn Walker, is gay. The San Francisco Chronicle's SFGate has the full report, and the article cites many sources who say they do not expect his sexual orientation to influence his opinion...

"An Excellent Comment on Comment Moderation"

Posted on February 07, 2010
As a general rule, I avoid aggressive monitoring of comments. I could probably have a more civil comments section if I were more willing to delete nasty comments and ban trolls...

"Question Time defined"

And now the fun begins ... reading all 219 pages of the #iiTrial decision

Posted on February 03, 2010
As I type this I am printing out the 219 page judgment of Justice Cowdroy in Roadshow Films Pty Ltd v iiNet Limited (No 3).  For most this may seem a particularly tedious document to read, but for law nerds like me, this is what we live for.  I can feel the adrenalin pumping through my body as I quickly scan each page as it comes out of the printer, as I quickly do my best to understand the intricacies of Justice Cowdroy's judgment and figure out what it will mean for iiNet today as well as for the industry moving forward...

iiNet wins at first instance: judgment now available online #iiTrial

Posted on February 03, 2010
