A little know fact is that unions can sue for breach of contract (the collective bargaining agreement) if the collective bargaining agreement does not contain final and binding arbitration. We do not see many such cases in the private sector, but there are a fair number of these cases in the public sector. Matter of Sheriffs Officers v. County of Nassau, ___Misc. 3d____(Nassau Co. Oct. 7, 2008)(registration required) is an example of one such case. In this case, the plaintiff union obtained summary judgment on breach of contract issue.
