Can I Sue The Hospital And Insurance Adjuster For Incompetence?

This concerns an uninsured motorist accident of May 2008. The hospital submitted non-uninsured motorist bills to the insurance adjuster for payment.

A major insurance carrier and its claim adjuster paid off non-uninsured motorist hospital bills since the hospital put a lien on the settlement disbursement funds. Do I have a case against the hospital and the major insurance carrier to sue them both for incompetence when the hospital included a workman's compensation bills and when the claim adjuster paid off the hospital when we requested him not to do so since he was unaware of the hospital billing system inaccurate record keeping? He told us he would not release the check unless we had reached a payment agreement of which we did not and it appears where the hospital had been in touch with our claim adjuster and not us. We found out that the claim adjuster paid off the hospital. So can we sue both the hospital and the major insurance carrier for what maybe unfair insurance practices? It seems they had been in contact with each other without my knowledge! Thanx.
