DEAD AND FORGOTTEN

Posted on April 03, 2009
The New York Times, which has rightly earned a reputation for providing perhaps the most in depth immigration coverage of any newspaper in the country, has an important story this morning on how Immigration and Customs Enforcement has not been forthcoming on reporting deaths of detainees in its custody...

ICE PAYING IMMIGRANT DETAINEES $1 A DAY FOR WORK

Posted on April 02, 2009
The Houston Chronicle has run a report showing Immigration and Customs Enforcement is paying detained immigrants in Houston detention centers $1 per day for performing work such as cleaning, doing laundry, washing dishes, working as barbers, working in the medical clinic and more...

OMBUDSMAN OFFERS COMMONSENSE SOLUTIONS FOR USCIS PAYMENT PROBLEMS

Posted on April 01, 2009
When I was a rookie lawyer nearly 20 years ago, I remember being thoroughly embarrassed because I calculated a fee incorrectly on a visa application and ended up costing the client several weeks delay in getting their visa. It's a mistake that was easy to make given the myriad of forms and separate fees that are included in many applications...

MICROSOFT STICKS UP FOR H-1B WORKERS

Posted on April 01, 2009
I'm glad one of America's greatest companies is not afraid to tell it like it is on the subject of skilled worker immigration even if they'll get flak. Mean time, protectionist Senator Chuck (wait, I'm a Republican?) Grassley continues to beat the drums for destroying the H-1B program...

FORBEARANCE?

Posted on April 01, 2009
Is the Obama Administration preparing to torpedo plans for comprehensive immigration reform this year in exchange for a series of lesser interim reforms? I'm trying to read the tea leaves and am really curious about something Vice President Biden said on his recent Central America trip...

IMMIGRANT OF THE DAY: DAVID CAMPOS - POLITICIAN

Posted on March 31, 2009
Guatemalan-born David Campos has overcome his status as an illegally present immigrant kid in the US to become a legislative leader in San Francisco. Campos earned scholarships to college and law school and became a prominent civil rights lawyer in the Bay Area...

ICE OPENLY DEFIES SECRETARY NAPOLITANO

Posted on March 31, 2009
This is getting interesting. Remember my post from a few weeks ago about a work site raid in Washington state that apparently was conducted by ICE in direct opposition to the wishes of Secretary Napolitano. Now it appears that some at ICE are reveling in taking on the boss of the agency and, by extension, the new President...

IMMIGRANT OF THE DAY: MIGUEL BLAS-MATUS - MEDICAL STUDENT

Posted on March 31, 2009
Miguel Blas-Matus' story is another example of the tenacity of many out of status immigrants in the US. He entered the US legally from his native Mexico with his US citizen wife, but due to what seems to be malpractice but an incompetent immigration lawyer (I wish I could say this was more rare than it actually is), he fell out of status...

AUSTRALIA LATEST COUNTRY TO GUARANTEE IMMIGRATION EQUALITY TO SAME SEX COUPLES

Posted on March 30, 2009
Common sense (and decency) from our friends Down Under. I hope immigration reform advocates on the Hill don't forget to deal with this important issue when they craft legislation this year.

A PLAN TO TAKE CONGRESS OUT OF THE EQUATION ON DETERMINING FOREIGN WORKER NUMBERS?

Posted on March 27, 2009
The LA Times has a very interesting article talking about potential plans for comprehensive immigration reform that involve a major - and risky - change in strategy. According to the report, the CIR bill would look very similar to prior years, but in order to appease labor unions, a new independent commission would be created to assess employment-based visa numbers...

COURT RULES USCIS MUST ALLOW CONCURRENT FILING OF RELIGIOUS WORKER ADJUSTMENT APPLICATIONS

Posted on March 27, 2009
This is great news for those waiting forever on I-360 applications. A US District Court in Seattle has ruled that USCIS must accept adjustment applications concurrently with I-360 religious worker green card applications, something allowed for all other employment-based green card cases (except those in backlogged categories)...

IMMIGRANT OF THE DAY: PAVEL GOBERMAN - EXERCISE GURU/POLITICIAN

Posted on March 27, 2009
This guy's got gumption. Pavel Goberman is a 71 year old Russian immigrant who came to the US in 1980 and has become a fitness consultant in Oregon. He's running for US Senate against Democratic incumbent Ron Wyden and while his odds of winning are slim, his enthusiasm will no doubt make the race more interesting...

IS ICE ABOUT TO EMBARRASS WHITE HOUSE AGAIN WITH AN UNAUTHORIZED WORK SITE RAID?

Posted on March 27, 2009
A reliable source has informed immigration lawyers in the mid-southern United States to be prepared for a major work site raid in or near Canton, Mississippi. While the White House has not formally stated it has suspended raids while it is reviewing its enforcement policy (something that many leaders in Congress have urged), such a moratorium is believed to be in operation right now...

CLINTON PROMISES MEXICO ACTION ON IMMIGRATION REFORM

Posted on March 26, 2009
The Secretary of State told an audience on her Mexico trip that the Administration will move on the issue this year. That's encouraging, though people need to remember that President Bush made the same promise to Mexico.

IS THIS THE YEAR THE DREAM IS REALIZED?

Posted on March 26, 2009
Leaders in Congress today re-introduced the Development, Relief and Education for Alien Minors Act, better known as the DREAM Act. The bill would allow immigrant students raised in the US and who are graduates of US high schools to attend college or join the military and embark on a path to citizenship...

HOUSE DEMOCRATS GEARING UP FOR INTRODUCTION OF COMPREHENSIVE IMMIGRATION REFORM BILL

Posted on March 25, 2009
The Hill's take is consistent with what I'm hearing from my own sources at the Capitol.

DOBBS APOLOGIZES FOR HISPANIC CHAMBER REMARK

Posted on March 25, 2009
Remember the other day when Lou Dobbs went loco and claimed the US Hispanic Chamber of Commerce was actually a drug dealing organization tied in with Mexican mobsters? Well it turns out CNN actually does draw a line on on this kind of outrageous conduct and Mr...

IMMIGRANT OF THE DAY: JORGE MUNOZ - PHILANTROPIST

Posted on March 22, 2009
Most people think you have to be wealthy to be a philanthropist. But the term, which literally just refers to one who loves people, refers to anyone who donates money, time or expertise to benefit a socially beneficial cause. And one ordinary American who got some well-deserved attention this week is Colombian-born New York City bus driver Jorge Munoz...

HISPANIC LEGISLATORS PUSHING ON IMMIGRATION REFORM

Posted on March 18, 2009
Two developments today: 1. Members of the Congressional Hispanic Caucus had a meeting today with President Obama to press on immigration reform. The President indicated he is going to push on a reform bill this year. That we knew. But he also indicated he would hold some kind of "public forum" in about two months...

SHERIFF JOE WON'T COOPERATE WITH JUDICIARY COMMITTEE

Posted on March 18, 2009
If you really believe everything in your operation is Kosher, why hide from Congress?

WASHINGTON POST ENDORSES PROPOSAL FOR IMMIGRATION EQUALITY FOR SAME SEX COUPLES

Posted on March 17, 2009
Kudos to the Washington Post for writing a strong editorial supporting the Uniting American Families Act which would treat same sex couples the same as heterosexual married couples for purposes of receiving immigration benefits.

IMMIGRANT OF THE DAY: NEIL GAIMAN - CHILDREN'S AUTHOR

Posted on March 17, 2009
British-born author Neil Gaiman is having a big 2009. His new novel, The Graveyard Book, just won the Newberry Medal, the equivalent of the Oscar for children's literature. And another one of his books, Coraline, has been adapted by Tim Burton in a new animated feature film (in 3-D!)...

BORDER PATROL TRIES USING MUSIC AS PROPAGANDA TOOL

Posted on March 17, 2009
A reader sent me a link to a story in the Washington Post which discusses a little known program where the Border Patrol is paying musicians to write songs warning Mexicans about the dangers of crossing in to the US. And they seem to think its working (though I have no idea how they really could tell).

HOW IMMIGRANTS CAN FIX THE HOUSING BUBBLE

Posted on March 17, 2009
Various readers of this blog have been making this suggestion, but when folks say the same thing in the Wall Street Journal, that gets more attention. CNBC correspondent Erin Burnett also pointed out this piece this morning on Morning Joe on MSNBC.

USCIS DOCUMENT REVEALS OFFICIAL POLICY TO DISCRIMINATE AGAINST SMALL BUSINESSES IN H-1B CASES

Posted on March 16, 2009
How ironic to find this out on a day when the President announced a policy to aid small businesses. U.S. President Barack Obama will announce steps on Monday to make it easier for small business owners to borrow money, using $730 million in stimulus funds to cut lending fees, boost loan guarantees and expand other programs, officials said...

H-2A REGS SUSPENDED FOR NINE MONTHS

Posted on March 16, 2009
Reacting to criticism from farmworker labor organizations, Secretary of Labor Solis has suspended for nine months the new H-2A regulations. According to Farmworker Justice: These policies are extremely harmful to farmworkers, both domestic and foreign, slashing wages, reducing worker protections and eliminating government oversight in an industry known for labor abuses...

DHS NOW SEEKING TO DEPORT DEAD PEOPLE

I kid you not.

DOBBS GOES LOCO

Posted on March 13, 2009
Kudos to America's Voice for calling Lou Dobbs out over his latest outrageous statements.

TIME TO PURSUE A BUSINESS INVESTMENT VISA?

Posted on March 12, 2009
I am continuing to hear from many of you asking what to do if you lose your job. I?ve written an extensive article on the topic that can be found at http://www.visalaw.com/08oct2/2oct208.html. The article focuses mostly on how to stay legal and how employers can make sure they don't unnecessarily harm their workers...
