After putting out information about the new additions to the Davis Stirling Act for 2010, I got the following question: "We already include all items in the index in the year end disclosure packet. When a board position becomes vacant, some boards would prefer to appoint board members to fill them and others would prefer to wait for or hold a special election to fill the position. In any situation, the person who fills the position of the director whose position is vacated is in there for the term of the board member they replace, and not a new term (unless the Board waited until the election and the "exited" (is that a word?) director's term is up as of that election...

In the condo and HOA setting, I often hear something like this: That other attorney (person, board member, neighbor, etc.) is a rat. There is no way this is going to settle without a lawsuit. Are you an attorney that will "attack"? First of all, I will say that I am an attorney that will try and figure out the best way to resolve a legal (or practical, if that comes before me) problem for a client, and a lawsuit is never the "best" way...

There is a continuing debate going on about HOA and Condo Association hearings. And it is an interesting one. Debate is healthy. It stirs interest in a topic. The point under discussion: what is required of a board to address a situation where there is a continuing or recurring (someone wrote and asked me to stop using re-occurring which is fine with me) violation of the rules? And what is the difference between continuing and recurring? I think we all agree that continuing means something that goes on day to day without changing, such as a paint color or vehicle parked without being moved...

There is no law on this. Boards are not required to accept or respond to emails, so if the Association policy is to communicate otherwise, such as coming to a meeting and addressing the Board during homeowner forum time, or the old fashioned "write a letter" method, I would suggest following it...

I get this question at least two or three times a week. Question: I'm not sure if I need an attorney. My condo was recently foreclosed. Now I have received a complaint from my HOA for dues that I did not pay before my condo was foreclosed. I thought they would take the money that I owed through the foreclosure, but I guess they never opted to get their money through the foreclosure proceedings...

Lots of people want to know whether owner "chat lines" are a good idea. They can be. It is nice to have a way that homeowners can communicate ideas, questions, etc. ... at least in theory. In California, homeowners in HOAs have a right to review most if not all of the Association contracts ("executed contracts not otherwise privileged under law" - Civil Code Section 1365.2). About assessments ... sometimes when I write about assessments, I get questions back that I do not really understand, meaning I do not comprehend what is going through the minds of readers. So then I think it is time to try and explain. Here are some such recent questions that were asked me by a reader: "My questions to you are as follows: Doesn't the quorum requirement stated in 1366 (b) below have to do with the HOA's ability to conduct the Special Meeting to discuss the Special Assessment, rather than the percentage of Membership approval?" Some HOAs assess all owners equally and some allocate assessments on a pro rata basis based on exterior surface size or square footage of a unit.
