Do You Have To Give Owners the Mailing List? How About the Email List?

ADVERTISEMENTS

With the interest in the internet and web as a source for finding answers, many HOA owners are becoming more informed, maybe even more inquisitive. Thus, owners are asking for more information from boards and if it is not forthcoming they want to communicate with owners. California law affords owners that right. Last year, there was a case decided in California (Worldmark v. Wyndham et al.) that suggests that the email list kept by HOAs and Condos must be provided to owners, or at least the alternative of having the HOA send out an ownner's communication via email, if it uses the list to communicate with owners.

Are you concerned yet? Get the skinny on this case from my perspective in the E-Newsletter this month, which should be coming out right about now. If you are not on the list you will have to wait until it is posted by my web person, which usually occurs within 24 hours of distribution.

This is important information. Attorneys do not agree on the effect of the Worldmark case as to whether it requires HOAs and Condo Association Boards to provide owners with access to it, or alternatively, to have communications sent out using it. There is a reason why.

To find the E-Newsletters, visit www.californiacondoguru.com, go to the main page and click on E-Newsletter Archive and by the way, while you are there, sign up so you don't miss the next big news on the HOA front.
