5th Circuit: San Antonio can impose and waive fees or march organizers

International Women's Day March Planning Committee v. City of San Antonio, No. 09-50692 (5th Cir. Sept 8, 2010) "We find that San Antonio is not engaging in content or viewpoint-based discrimination, at least not by waiving fees for the limited number of events under consideration in this case . . . San Antonio?s provision of financial support for certain processions does not demonstrate that it bears any animus against the viewpoints expressed by the plaintiffs in the International Women?s Day Parade or other marches. San Antonio is not singling out disfavored viewpoints for sanction; instead, it is singling out a limited number of favored messages for special treatment . . . "
