Mortgage Refinancing

My father recently re-financed his home and was told they would give him $8,000.00 out of their loan origination fees for him to pay his credit cards off. He didn't qualify for any cash out so they were going to take care of him this way, as long as he did his loan thru them. He ended up getting a higher mortgage, no cash to pay his credit card off and never did he get a copy of his loan documents. He was told his mortgage payment would be a lot less and to date keeps getting promises that he will get the money to pay his credit card off. Are they in violation for anything? What can be done if the loan had no benefit to him? He now has a higher payment. I need to act on this fast. He re-financed because he couldn't afford the payment and now its more.
