
I was named beneficiary to my deceased ex husbands nys retirement benefits before we entered into marraige. he never changed me as beneficiary . unfortunatly as I have stated he has passed on nove 11,2010. i was sent a letter from nys retirement system confirming such , and was told they were doing the calculations, and i would recieve the benefits upon furnishing them with proper id and a copy of the death certificate. I have complied with this.
In continuation.I received further emails, and regular mail stating they were just awaiting for his most recent retirement statement from his last job he served as a civil servant in the nys retirement system,they then sent me yet another email stating,they received the info and were doing the final calculations, and I were to receive the benefits within 2 weeks.I then received a letter stating I was not entitled to the benefits as we were no longer married and he did not fill out a dro form. my question is ..I was named beneficiary prior to the marraige , which to me is of a contractual nature, not of a domestic one. the final letter from nys retirement stated they would keep the case open for 4 months . what is my recourse if any ?
