Can we get out of paying equity loan if the notary was never present when we signed the documents

We have an equity line of credit and just finished our bankruptcy case. During the bankruptcy, we came to find out the bank that has our equity loan does not have any of our paperwork. they ignored my calls to try to dig this up. it is registered in the courthouse. But when we signed the papers the girl did not notarize our signature in front of the notary. The notary did it on her own when we weren't there. can we get out of paying this since they can't find out documents or that the notary didn't sign in front of us or witness our signature?
