If I pay restitution, can I still be charged with a crime?


I stole around $9k from a former employer. This employer recently found out and started an investigation with the police. When the police contacted me, I confessed and they said they would leave it up to my former employer. He said if I paid him the $9k he wouldn't charge me with a crime. If I do pay him, can he still press charges against me?
