By Philip Brooks
World Research Group is hosting a webinar titled, "KSR Update: Withstanding the Obviousness Challenge" on January 24, 2008. John Richards of Ladas & Parry LLP will present the program.
Overview
In what may be the most important patent case in the last 20 years, The Supreme Court recently sided with The Federal Circuit?s critics who claimed The Circuit?s interpretation of what should be patentable was too liberal. In KSR vs. Teleflex, The Court ruled in favor of KSR, who argued successfully that Teleflex?s patent for its adjustable accelerator pedal was invalid due to obviousness.
The Court?s handling of obviousness and prior art in this landmark case has made obtaining and defending patents more difficult. The Court of Appeals for the Federal Circuit and the PTO have now started to flesh out the implications of the KSR decision. What does this decision mean to the IP community? How can patents withstand the obviousness challenge in this new era? This webinar provides the patent practitioner with a better understanding of the way in which the Court and the PTO are applying the KSR decision as well as strategies for effectively dealing with its implications.
Agenda:
- Understanding KSR, What does it mean to the patent practitioner?
- Redefining ?Obviousness? and ?Prior Art?
- Obtaining and Defending Patents in light of the KSR ruling
