: Legal Pad | LAFormer employee's privacy not violated by handwriting analysis
By Richard Binder
The 4th District Court of Appeals decided last week that Tustin police officers did not violate a former employee's privacy by analyzing her handwriting on 28 documents.
Janice M. Ohman, a former police records clerk, had been charged with forgery after hundreds of magazines and books were delivered to the city manager in 2006. Detectives gathered subscription cards and 28 documents from the city for handwriting analysis. Because those documents were obtained without a warrant, the evidence was deemed inadmissible and the forgery charge was thrown out. Ohman filed a civil suit claiming invasion of privacy, and the court determined that because the information in the documents had already been made public in past court proceedings her privacy had not been violated.
Ohman appealed the decision, and the 4th District upheld the previous findings.
