By Michael C. Smith
On March 19 the jury in the Thermapure v. Water Drying Out Corp case in Judge Everingham's court in Marshall concluded their deliberations with a verdict that was unanimous except for the damages question, i.e. it found infringement, not willful, and not invalid, but hung upon damages. The Court accepted it as a partial verdict and gave the parties fifteen days to file motions regarding what should be done with it. Postverdict motions (JMOLs and the like) are pending and the motions on what to do with the verdict will be in soon.
