Legal Ethics Items (September 15, 2010)

ADVERTISEMENTS

  • Legal Profession Blog: alleged billing fraud by GM's outside counsel.
  • ABA Journal: In South Carolina, having sexual relations with a client's wife is per se unethical.
  • Main Justice: a new hearing date has been set for the contempt hearing against the DOJ lawyers involved with the failed prosecution of Senator Ted Stevens.
  • Legal Malpractice Law Review looks at an unpublished decision from California denying beneficiaries the stand to sue for legal malpractice.
  • Karl Bayer.com looks at the August decision out of Texas, In re Mary Lynn Mabray, holding that cooperative law agreements in divorce proceedings do not violate public policy.
  • White Collar Crime Prof Blog: the NACDL is holding a conference in DC tomorrow on the "willful blindness" doctrine.  While typically applied against corporate executives, lawyers need to understand how it can be applied to lawyers too.  (David Luban wrote an article, Contrived Ignorance, (87 Geo. L. J. 957 (1999)) dealing with the issue. I can't find a copy online.)
  • Law & Humanities Blog: two profs at Harvard are using the HBO series, The Wire, as a course text.  The series has many scenes suited for PR class, mostly involving prosecutors and defense lawyers, but some involving police (pronounced in Baltimore, as it was in DC when I was a kid, "PO-lice.")
  • Greek lawyers don't like reforms that open up competition in the profession.
