Posted on January 06, 2011
Kids, when you need to ask a judge for an enlargement of time, this is how you do it:This request is not meant to delay any matters before this Court.  The Order was issued in the middle of the holiday season, and as Plaintiffs' counsel clearly was not working as hard as the Court, were not addressed until after New Year's...

3d DCA Watch -- Judge Schwartz Kicks Off the New Year With a Bang!

Posted on January 05, 2011
Our favorite Senior Judge had a big week to kick off 2011. Let's take a look:Tahiti Beach v. Pfeffer:Here the good judge just sits on the panel as Judge Salter, in his usual efficient and logical way, disposes of Andy Hall's appeal on behalf of swanky Tahiti Beach, which had imposed a $285k fine on a homeowner for not completing their construction or landscaping within 24 months...

Justice Scalia Thinks the 14th Amendment Applies Equally To All Hetero Men.

Posted on January 04, 2011
Amanda Terkel notes a quite astonishing interview with Justice Scalia from the California Lawyer:In 1868, when the 39th Congress was debating and ultimately proposing the 14th Amendment, I don't think anybody would have thought that equal protection applied to sex discrimination, or certainly not to sexual orientation...

3d DCA vs. 1st DCA -- Let's Compare Courthouses!

Posted on December 29, 2010
There is an unintentionally hilarious article in the Florida Bar News that curiously does not involve or even mention my pal George L. Metcalfe. It purports to compare the palatial "Taj Mahal" like new 1st DCA facility with, of all things, our own little bunker...

11th Circuit Thinks Bill Amlong Should Have Used X-Ray Glasses!

Posted on December 29, 2010
The meatball man does a nice job covering it, but I want to add a few points about this extraordinary 11th Circuit opinion sanctioning Bill and Karen Amlong.Preliminary question for Judge Carnes -- why do you note on page two that the plaintiff is an "illegal immigrant"?Regardless, the good Judge, in a 74-page opinion(!) pulls no punches:The Amlongs? attempt to alter their client?s deposition testimony in 868 ways was of a piece with their conduct throughout the litigation...

Neil Rogers RIP

Posted on December 24, 2010
It is with great sadness that we note the passing of Neil Rogers.Neil was a formative influence in my life and helped shape who I am today.  He was smart, funny, irreverent, fearless, and spoke -- sometimes yelled -- truth to power.Even when he started in South Florida, doing "issue" radio in the mid-70s, he was sui generis...

Hand-Pulled Noodle Case Slowly Unraveling.

Posted on December 20, 2010
Longtime readers know we have been tracking Mr. Chow's long hand-pulled noodle-like passage through the SD FL for some time now. There have been several substitutions in the cast of characters fondling handling this matter. Now it appears the defendants may be running out of money; at a minimum they have run out of Richman Greer's good counsel, as that firm has recently withdrawn from the case...
