All Frank Jimenez, All the Time.

Posted on December 23, 2008
I don't know, I feel like we're getting a little Frank Jimenez chronic here, and yet more news keeps breaking. Now it's this, in a fine story by Jordana Mishory:Late last week, as the controversy over Jimenez?s nomination simmered, the governor?s office moved up the planned interviews with the Supreme Court finalists from early January to today and Christmas Eve...

Raoul Cantero Writes Op-Ed Quoting Positive Comments About Raoul Cantero

Posted on December 23, 2008
Isn't it cool that as we get ready to inaugurate a new President, we get to fight about the 2000 Florida recount and the Bush years all over again?Thank goodness I don't have to write another post about Frank Jimenez. I tell you, I was thisclose to pulling a Lew Freeman and launching myself from the top of Wachovia like a despondent Rose DeWitt Bukater hoping to escape the loveless clutches of the very dastardly Billy Zane...

SFL Friday -- Holiday Windsurfing Edition

Posted on December 19, 2008
So there I was, my eyes locked and staring directly at Judge Altonaga, as I smiled slightly and prayed for a favorable ruling."You can have this table, SFL, we were just leaving.""Thanks Judge. Have a nice weekend."What -- you thought we were in court? I'm a civil litigator, don't be silly...

Rebekah Poston and Alvin Davis: Frank Jimenez Was A Good Worker.

Posted on December 19, 2008
I mean why all the contretemps, what more do you need:Rebekah Poston, Jimenez's former boss at the law firm Steel Hector Davis in Miami, said that based on the work he did for her, Jimenez would be an excellent choice for the Supreme Court. ''He was a superb writer, superb researcher and his ethics were beyond reproach,'' she said...

Postcards From Europe (They Write Letters....)

Posted on December 15, 2008
Joining the illustrious list of attorneys who for some reason write letters to the Miami Herald, we now have Alan Becker: Criticism of Gov. Charlie Crist's trip to Europe is unfair. There is a reason that I and other Florida business leaders travel, at our own expense, on Team Florida missions: They help create investment and jobs in Florida...

Foot of Pride Monday for Marc Dreier and Bernard Madoff -- WTF?

Posted on December 15, 2008
Hi folks, it's another Monday morning in paradise. The Dolphins won, the stock market stinks, and I have a hearing in 20 minutes. How was your weekend?I've been thinking a lot about the implications of two astonishing frauds committed by well-respected, credible members of the business and legal community -- Marc Dreier (of Dreier LLP), and former NYSE chair Bernard Madoff...

Howdy folks, so are you on the guest list to the Gov's big "marriage" thingy? What's that, you won't say?Oh I get it -- don't ask, don't tell.Well the Herald leaked a few names anyway -- funny, they all happen to be hotshot Republican plaintiffs' lawyers: Roberto Martinez, Dean Colson, and Paul Huck, Jr...

Judge Fay: Your Voice Was Heard!

Posted on December 11, 2008
Anyone at the recent Bench and Bar Conference remembers Judge Fay's rant on federal pay for the judiciary (in addition to his denunciation of "fat cat union bosses" who in his view destroyed the American automobile industry).Like the old Chris Rock joke about whoever you hate eventually becoming part of your family, it looks like the federal judicial pay raise and saving the auto industry along with all those fat cat union workers are now inextricably linked:If the $14 billion bailout plan for U...

Ervin Gonzalez Scores Another One!

Posted on December 11, 2008
What do you all think -- this strikes me as a tough case: Officer "Oreo" Lorenzo, a highly decorated Police officer with the City of North Miami Beach Police Department, was driving westbound on Pines Boulevard in Pembroke Pines, Florida on July 2, 2004, when 18 year old Natasha Russo failed to stop at a stop sign and attempted to make a left turn eastbound on to Pines Boulevard, causing Officer Lorenzo to swerve to avoid a direct impact...

3d DCA Watch -- Supplemental Spankdown Edition

Posted on December 11, 2008
I don't usually cover criminal or juvenile in 3d DCA Watch (Rumpy has the MIA criminal beat more than adequately covered) but this 3d DCA spankdown of Judge Langer transcends its limited genre:In B.M., we painstakingly elucidated the statutory parameters which bind the judges of the juvenile courts of this state in the detention of juveniles...

3d DCA Watch -- Judge Salter and Unchecked "Zealous Advocacy" Edition

Posted on December 10, 2008
Hi kiddies, I'm in such shock over this opinion by the 3d released this morning that I'm gonna dispense with my coffee-swilling niceties and get right to it:Hernandez v. Gil:Wow, wow, and triple wow. Judge Salter decided in this opinion to simply unload on appellant and his present counsel, Alba Varela, and instruct us all on what it means to be a "zealous advocate" AND ALSO an officer of the court, AND ALSO a professional colleague to your opponent...

Sorry, Your Crappy Document Coding Project Has Been Outsourced to India

Posted on December 10, 2008
Intrepid reporter Julie Kay files a well-researched and nuanced piece on big firms sending their document review and other legal work to India: The general consensus is that law firms and corporate counsel began outsourcing lower-level legal work to India -- and a small number to the Philippines -- about five years ago...

Teflon Class Action Up in Flames

Posted on December 09, 2008
Hi folks, I'm back from court. I decided to draw back on my elaborately constructed straw man arguments and simply argue my case on the merits. Ok, I sprinkled in a little Carver Time for dramatic effect -- after all, I was in state court.Court took it under advisement, so we'll see...

My Straw Man's Better Than Your Straw Man

Posted on December 09, 2008
So I'm preparing for a court hearing later this morning. My plan is to construct an elaborate straw man, a badly distorted reading of my opponent's position taken to an absurd extreme, so that I can then argue that every person of good will and fair conscience must agree that such an dramatically extreme position has to be rejected...

Rebalancing The Scales of Justice -- Get a Room, Liberty!

Posted on December 08, 2008
This is an interesting WP story on the impact Obama will have in restoring some balance to the federal judiciary, especially at the appellate level:The federal judiciary is on the verge of a major shift when President-elect Barack Obama's nominees take control of several of the nation's most important appellate courts, legal scholars and political activists say...

Charlie Crist Sets Example, Spends Only $430k on European Vice-Presidential Victory Tour

Posted on December 08, 2008
Yes it's Monday, I'm grumpy, plus I'm getting sick of this sub-70 weather.Ok, let me try this again -- how was your weekend?I love reading the papers nowadays. For example, there's this heartwarming story:In a nod to the increasingly desperate times faced by Florida citizens, Charlie Crist got the hail out of the state with his "ladyfriend" and nine really hunky bodyguards (two photographed above), and visited anti-American places like Spain, France and England...

SFL Friday -- From Fiefs to Surfs

Posted on December 05, 2008
Well it's the end of the work week (for those of you who still have jobs, that is), and yet all is not bleak. Sales of booze are up, for example. And there's this good news -- White & Case to reorganize their firm:At the heart of the new structure is a power shift from the firm's 35 offices to 14 regional groups, reports the Am Law Daily...

"helping investors recover their losses...." or something like that. That was from a sponsorship spot I heard on NPR last night as I was listening to "All Things Considered."30 years? Ok, if you include that time when I was seven and Scotty helped me get back my lunch money that bully stole from me, so I guess technically it's accurate...

Boca Attorney Alleged To Live In Own "Virtual World."

Posted on December 04, 2008
Hi folks, this is one strange story: Six people have been charged with participating in a scheme to steal more than $40 million in settlement funds from class-action lawsuits. According to the indictment unsealed in Philadelphia by Acting U.S. Attorney Laurie Magid, the accused submitted numerous false and fraudulent claims in three class-action lawsuits - all of which were eventually settled - between 2001 and 2007...
