Glenn Garvin, Legal Scholar.

Posted on February 10, 2009
Forget 2012, the apocalypse is now:Continuing its slide into self-parody, the Miami Herald's lovable right-wing TV critic, Glenn Garvin, is now also a legal scholar. In the first of his biweekly opinion columns, he wades into the 11th Circuit's Vamos a Cuba opinion, and naturally gets everything pretty much totally wrong:Librarians may imagine themselves high priests, beyond the control of mere mortals, but the School Board correctly recognized them for what they are: public employees, accountable to the people who pay their salaries...

Rick Ross, YouTube, and the Carol City Gang.

Posted on February 09, 2009
TSG has posted a fun transcript involving our own fake tough guy rapper, Rick Ross:The rapper Rick Ross would have his fans believe that he made millions trafficking cocaine while running with one of Miami's violent street gangs. Of course, that claim took a hit recently with the disclosure that Ross (real name: William Leonard Roberts) actually once worked as a corrections officer, news that was met with derision in hip-hop circles...

Thomas J. Rebull assures Herald readers that despite the nationwide search for the Civilian Investigative Panel's executive director, it is quite possible someone from South Florida is somehow competent enough to handle the job:The search beyond South Florida simply means that the CIP wants to make sure that it finds the best person for this community...

Judge Carnes Fiddles; Meanwhile, Our Schools.....

Posted on February 06, 2009
Oy -- I could have guessed the result when I saw that Judge Carnes authored the Vamos a Cuba decision reversing Judge Gold's reasonable and measured ruling:In a 2-1 decision, the 11th Circuit Court of Appeals in Atlanta said the board did not breach the First Amendment, and ordered a Miami federal judge to lift a preliminary injunction that had allowed Vamos a Cuba to be checked out from school libraries...

Grand Slammin' It With Jeremy Alters and Bruce Rogow.

Posted on February 04, 2009
So there I was yesterday, waiting patiently with the unwashed masses for my free Grand Slam breakfast over at the Denny's on Biscayne Boulevard and 36th street, when who walks in but Jeremy Alters and his entire Design District firm, including new special counsel Bruce Rogow:"Hey guys, hold on a minute -- what are you doing? There's a long line here, you can't just walk in and jump over everybody else...

Never Give A Sucker An Even Break!

Posted on January 29, 2009
Well I sure hope everyone is watching that great PBS documentary series on comedy in America, Make 'Em Laugh, which was on again last night. If you want insight into the anti-authoritarian, mostly Jewish outsider perspective that motivates us to make a lawyer or judge joke on this crappy blog every so often, take a look at this well-produced anthology...

3d DCA Watch Addendum -- Judge Salter Makes Giant Boo-Boo.

Posted on January 28, 2009
Everyone knows we love Judge Salter around here, but several readers have alerted me to this whopper, in finding that a class rep is not "adequate" because it (a small company with limited assets) could not shoulder the costs of class notice:While the class?s attorney?s fees may be contingent, the costs of mailouts, administration of opt-outs, establishment of a web site, expert witness fees, document production, and transcripts, for example, generally fall in significant part on the class representatives...

Hy Shapiro Raises Interesting Legal Question.

Posted on January 27, 2009
Let's say you're a nice young Miami Beach arms dealer, interested in shipping huge amounts of ancient Chinese munitions, stored in dubious conditions in Albania for decades, to our fightin' boys in Afghanistan.Oh -- you also want to grossly overcharge American taxpayers in the process, and still have time to take in a nice dinner at Barton G before nightfall...

That's Why I Love Miami....

Posted on January 26, 2009
My inner Philosopher-King got slightly annoyed by this WP opinion piece by sitting 4th Circuit Court of Appeals Judge J. Harvie Wilkinson III, in which he both denies that the 4th Circuit is ideologically very conservative, yet pleads that the status quo on that bench stay the same forever:Ideological fervor is law's great antithesis...
