Posted on June 01, 2008
The Houston Chronicle ran an interesting commentary this weekend about the Houston Court of Civil Appeals overturning a plaintiff victory against Merck, Inc. in a Vioxx lawsuit. The gist of the article is that the appeals court has taken the place of the judge and jury...

Uninsured Drivers' Cars Will Soon Be Towed In Dallas

Posted on May 29, 2008
In keeping with the laws of several suburbs, the City of Dallas has now voted to tow the cars of drivers who cannot produce proof of auto liability insurance after a traffic stop. The vote was divisive, along racial lines, with opponents arguing it places an undue burden on lower-income residents...

Iraq Veterans Suffer Increase In Post Traumatic Stress Disorder Injuries

Posted on May 29, 2008
The Chicago Tribune reports an increase in the number of post traumatic stress disorder injuries suffered by military personnel in Iraq, coinciding with the "surge" in troop strength. This is doubly tragic for our brave vets ? they suffer terrible injuries, and then we mistreat them by failing to provide proper diagnosis and treatment in our medical facilities...

Yes, It Really IS This Bad In Texas

Posted on May 28, 2008
When I talk with personal injury lawyers who practice outside Texas, they sometimes think I'm exaggerating when I tell them how hard it is for injured claimants to win a case here. No, I'm not exaggerating. My evidence is a decision rendered today by the Court of Appeals, Fifth District of Texas at Dallas...

Texas Panel Calls For State Oversight Of PPO Health Insurance Plans

Posted on May 23, 2008
As reported in the Dallas Morning News, the Texas Sunset Advisory Commission said the lack of state authority over PPOs is "outdated" in the current health care environment and may result in harm to a large number of consumers if the situation remains unchanged...

Google Wants Your Medical Records ? How Trusting Are You?

TV Report Shows Proposition 12 Claims Overblown

Posted on May 16, 2008
An investigative report by KDFW reviewed the impact of legal changes made in 2003 that stripped patients of their legal right to hold a negligent doctor accountable. The report found that there was no glut of claims filed before 2003, that Texas has not seen a dramatic increase in the number of physicians, and that insurers are the only true beneficiaries...

Isn't The Smart Car Cute?

Posted on May 15, 2008
This is definitely not an endorsement of this tiny vehicle, but I just love the looks of the Smart ForTwo car. I've seen several in Dallas, and had a chance to examine a couple of them up close. They so much smaller than a Cooper that it's startling. And the Smart Car Web site is almost as cute as the car itself.

Texas Vioxx Verdict Overturned

Posted on May 15, 2008
Vioxx plaintiffs were dealt a blow yesterday when a Texas appellate court overturned a 2006 jury verdict. The verdict was rendered against Merck in the amount of $32,000,000. This was automatically reduced under Texas law, but has now been reversed completely because the San Antonio appellate court said there was legally insufficient evidence to support the state court verdict, and that the plaintiff's family failed to rule out the man's pre-existing heart condition as a cause of his fatal heart attack...

"Credibility Problem" Of The Texas Supreme Court

Posted on May 09, 2008
The Dallas Morning News published an editorial today regarding the credibility problem of our current Texas Supreme Court. Texas May Actually Punish Uninsured Motorists (Finally)

Posted on May 08, 2008
As reported in today's Dallas Morning News, Texas may actually start getting serious about punishing uninsured motorists. Of course, I'll believe that when I see it happen. For many years, it has been against the law to operate a motor vehicle in Texas without complying with the financial responsibility act ? basically either showing proof of liability insurance or putting up a bond to be self-insured...

Workers' Health Insurance Costs Soar

Posted on April 30, 2008
Yesterday's Los Angeles Times had a good article on the outrageous cost of health insurance, especially relative to inflation. As a small-business owner, I struggle with this issue every year.
