: Legal Pad | LAHaidl case may appear before the state Supremes
By Richard Binder
Greg Haidl, Keith Spann and Kyle Nachreiner were each sentenced in 2005 to six years in prison for participating in a sexual encounter, captured on videotape, with an intoxicated woman. As part of their sentence, they were ordered to register as lifelong sex offenders.
They appealed their sentence to the 4th District Court of Appeal in Santa Ana, which affirmed the conviction and the sex offender status.
Last week Dennis Fischer, Haidl's attorney, filed a petition with the state Supreme Court that argues the men should not have to register as sex offenders because of their acquittal of the one charge (felony assault with force that resulted in great bodily injuries) that permitted prosecutors to try them as adults. The court will decide in 90 days if it will consider the case.
