Patent Case Transferred to Michigan

By Michael C. Smith

ADVERTISEMENTS

Dura Operating Corp v. Magna International Inc. et al, 6:08cv0455 (3/26/10)

Judge: John Love

Holding: Motion to Transfer Venue GRANTED

Here the plaintiff was from Michigan, as were two of the four defendants, with the other two from nearby parts of Canada, and pending litigation between the plaintiff and two of the defendants was pending in Michigan as well. Judge Love wrote:

"Just as in Odom [v. Microsoft Corp., 596 F. Supp. 2d 995, 1003 (Jan. 30, 2009)], where the parties were localized in the Oregon-Washington area, the parties in this case are localized in the Michigan-Ontario area and have no meaningful connection with the State of Texas. This is a case where the proposed transferee district is clearly more convenient. Accordingly, the Court finds transfer warranted."
