: Cocky Law BlawgTax Court declines to ?just Google it.?
By Pamela
In a recent decision, Cunningham v. Commissioner, the U.S. Tax Court has ruled against a taxpayer who exhorted the court to Google the name of his financial adviser to find proof that the adviser was a “charlatan.” In declining to Google, the court declared that it could not consider information not included in the record on appeal. T.C. Memo. 2009-194 at 4.
Perhaps the moral here is to Google during your preparation for trial and seek to get the information you find into the record, if it is helpful.
