A federal appeals court has upheld a lower court's decision to dismiss a lawsuit stemming from a fatal bicycling accident. In the decision, the 10th Circuit Court of Appeals held that the mountain bike riders knew that their participation in a 2004 race was inherently dangerous and the event's organizers took sufficient precautions to protect the riders. In the appeal, plaintiffs argued that race organizers were grossly negligent in their planning of the event.
