Argh! I have a motion to suppress set for Monday morning. My much needed percipient witness, who I finally got in touch with Friday night, hung up on me and turned her phone off after I introduced myself and told her why I was calling. I was pissed, but figured I could just put my client on to give the testimony I needed...not my first option, but whatever. In the life of a PD, I don't think things are ever perfect.But this morning, as I was doing some research on the issue, I found the case that sinks my whole motion. Sweet. The worst part is, is that my first instinct was that this was actually the status of the law, but I only got time to check it 8:00am this morning (Saturday morning legal research, nothing goes better with your morning coffee)...continue to full post
