: Northern Virginia Personal Injury LawyerFamily Awarded $9 Million in a Medical Malpractice Case a Decade Later
By Ben Glass
A family has been awarded at least $9 million in a medical malpractice case, nearly a decade after the death of their 12-year-old son.
On December 14, 1999, Andrew Muno underwent a surgical procedure at Condell Medical Center to repair a cut tendon on his left arm, but died during the procedure. According to the family’s attorney, he was given an antibiotic that he was allergic to, which led to breathing problems and his eventual death.
The family filed a wrongful death suit against Dr. Dale S. Gordon, the anesthesiologist, and the surgeon who operated on Muno.
A jury verdict in 2006 was in favor of the family and awarded them $7.5 million for their son’s wrongful death.
Dr. Gordon and Lake County Anesthesiologists attempted to challenge the verdict twice, but found no success, according to a spokesman for the attorneys.
On December 10, a judge upheld the initial award plus interest, granting the family more than $9 million.
