The question of whether or not there is judicial review of Troy Davis' death sentence -- eyewitness recantations and all -- is now up to the Supreme Court. Yesterday evening, the Georgia Supreme Court refused to stay tonight's scheduled execution, as noted in this AP filing via the Fulton County Daily Report.The Georgia Supreme Court on Monday refused to stay the execution of Troy Davis, removing one of the last obstacles to him being put to death on Tuesday. The vote, announced around 5 p.m., was 6-1.The majority of the justices said the U.S. Supreme Court, where Davis has another appeal pending, has jurisdiction.In today's Atlanta Journal-Constitution, Bill Rankin reports, "Protests planned against Davis' execution."Since Davis? trial, seven of nine key prosecution witnesses who testified against him have recanted their testimony...continue to full post
