How Public is LAX?

By Anne Skove, Esq.

ADVERTISEMENTS

The typical "public forum" for First Amendment purposes is a town square. Los Angeles, we suppose (we've never been), has no such thing.

Hare Krishnas are claiming that the airport is to LA what the bandstand is to River City.

Interesting enough in itself. Even better for court-watchers: the suit is in the federal courts, but the 9th Circuit has asked the state's highest court to determine the public forum issue.

One potential problem the court might consider: future generations will not understand the references in Airplane!

See State Supreme Court Asked to Help Resolve Krishna Suit, AP/Mercury News (June 9, 2008).
