Municipal Police Powers Trump Reverse Spot Zoning Claim

In the recent case of Andrews v. Amherst, 68 Mass. App. Ct. 365 (March 5, 2007) (Download), the Appeals court held that a Landowner of approximately 20 acres of vacant land which had been rezoned from a light industrial zone to a flood prone zone had no claim for reverse spot zoning on the part of the town, even though the plaintiff’s property was the only land to be rezoned in the area.
