BREAKING NEWS - NJ Supreme Court's Decision in Mt. Laurel v. MiPro

Today, the New Jersey Supreme Court issued a decision in Mount Laurel Township v. MiPro Homes which stated that towns may use eminent domain to condemn property for open space even when the property selected has been approved for residential development. The court declared that even after a town approves a project and development has begun, the town may seize the property even though the use is fully compliant with the town’s master plan.
