A group of NutriSystem sales associates are not entitled to overtime pay from a Pennsylvania call center, a federal judge has ruled. In a 25-page opinion, Chief U.S. District Judge Harvey Bartle III rejected arguments by attorneys for the plaintiffs that the company's pay scheme was comparable to "piecework" wages, instead finding that the plan was a bona fide commission system and therefore exempted under the Fair Labor Standards Act. The case is Parker v. NutriSystem Inc.
