By Cleveland Law Library
The Supreme Court of Ohio scheduled an October 14, 2008 execution date for Richard Wade Cooey. The scheduled execution will be Ohio's first execution in over a year. A de facto moratorium had been in place after challenges in several states arguing that lethal-injections constituted cruel and unusual punishement under the Eighth Amendement to the United States Constitution. The United States Supreme Court rejected that argument in Baze v. Rees. More details can be found in the Plain Dealer Article appearing on July 12, 2008. Also see our prior blog post on this issue.
