: Legal Pad | LAWeb site copyright infringement suit allowed
By Richard Binder
Brayton Purcell, a Novato-based personal injury firm, was handed a victory against two-lawyer San Diego-based Recordon & Recordon yesterday by the 9th U.S. Circuit Court of Appeals in an Internet copyright infringement case. Brayton Purcell, a 50-lawyer personal injury and asbestos firm, sued Recordon & Recordon for allegedly plagiarizing content from its Web site describing its elder abuse practice.
Recordon & Recordon filed a motion seeking dismissal, saying its Web site was strictly informational in nature and aimed solely at prospective clients in San Diego County. Brayton Purcell claimed unfair competition as part of its suit. Recordon also said the vendor they hired to design the site copied content without their knowledge.
The split 9th Circuit panel upheld an earlier lower court ruling denying Recordon's motion to dismiss.
