State high court rejects request for bar data by UCLA prof

The California Supreme Court rejected a request by a law professor to make the State Bar hand over exam data for over 100,000 test takers for his study, The Recorder reported. (here)

UCLA law professor Richard Sander has pursued the bar data to test his controversial belief, called "mismatch theory," that affirmative action hurts racial minority law students and that many of them would be better suited going to "less elite" law schools.

The State Bar has repeatedly rejected his request for the data - which would include race/ethnicity, gender, law school grade point average, LSAT score, law school attended, repeater status and actual bar exam score.

Sander then filed a writ of petition to the California Supreme Court.

The court made no ruling on the merits of the request but found it should be refiled in an appropriate court, The Recorder reported.
