By Harvey Randall, Esq.
Hadjitheodoro v Comptroller of Public Accounts, 252 A.D.2d 709
Disrespectful or confrontational behavior that persists despite repeated warnings may constitute disqualifying misconduct for the purposes of claiming unemployment insurance benefits.
Soterios K. Hadjitheodoro had been placed on probation for insubordination. He was terminated following an episode during which he stood up during a staff meeting and announced that his unfavorable employee evaluation was ?all lies? and that his superior was a ?liar.? He then threw his evaluation at his supervisor and continued to accuse his superiors although instructed to sit down.
The Appellate Division sustained the Unemployment Insurance Appeals Board?s denial of Hadjitheodoro?s claim for benefits.
