CIVIL CASES: "Fen-phen lawyer: Judge dawdling"

By Michael Stevens

ADVERTISEMENTS
From Cincinnati.com News:Fen-phen lawyer: Judge dawdlingSenior Judge Roger Crittenden is dragging his feet instead of resolving a dispute over millions of dollars related to Kentucky's fen-phen case, an attorney claimed Tuesday.AdvertisementLexington attorney Angela Ford first made the accusation last week when she asked the Kentucky Court of Appeals to order Crittenden to take action. She said the judge's repeated delays have made it impossible for her clients to collect money owed to them by their former lawyers.* * *Ford represents more than 400 people who sued their former lawyers to recover $42 million from the $200 million settlement with the maker of the diet drug fen-phen.The clients say their three lawyers - William Gallion, Shirley Cunningham Jr. and Melbourne Mills Jr. - took too much of the settlement. A judge agreed in 2007 and ordered the attorneys to pay back $42 million. The judge's "inordinate delay" has allowed the three lawyers to "dissipate, transfer or otherwise remove assets" that should be going to their former clients, Ford said.Crittenden could not be reached Tuesday.Ford's request to the appeals court says intervention is needed because Crittenden has failed to issue orders or, in some cases, has failed to enter written orders that support decisions he already made verbally in court.* * *
