Kartellrechtlich bedenklich ist allerdings Artikel 3.8b. Er legt fest, dass Google jede Einigung mit einem anderen Bieter übernehmen darf. Handelt also ein Verlag mit einem anderen Anbieter ein anderes Geschäftsmodell aus, darf Google dieses Geschäftsmodell auch auf die Bücher jenes Verlags anwenden, die sich bereits auf den Servern von Google befinden. Wenn Google jeden Konkurrenten kopieren darf, dürfte es aber schwer werden, ein Konkurrenzmodell zur Google Buchsuche zu etablieren.
