Plaintiff's verdict in Clearvalue case - $5.17 million in trade secret misappropriation & patent infringement damages

By Michael C. Smith

ADVERTISEMENTS

It appears to have been a hard-fought case, but at the end of day 7 of the Clearvalue v. Pearl River case the Tyler jury in Judge Leonard Davis' court finally returned a verdict.

On the trade secret misappropriation claims, the jury found for the plaintiff on two of the three asserted trade secrets, and set damages at an even three million dollars.

On the patent infringement claims, the direct infringement claims were out as a result of pretrial proceedings, so the jury was asked whether each of the two defendants contributed to infringement or actively induced infringement.  Defendant Pearl River was a yes/no while defendant SNF was a yes/yes.  The jury declined to find willful infringement and likewise declined to find the patent invalid, and set damages for the patent infringement claims at $2,172,617.
