: Eastern District of Texas Federal Court PracticeGeneral Order 09-07 amending local rules
By Michael C. Smith
Judge Folsom signed General Order 090-07 today, which makes some minor additional changes to the local rules based on comments received since the main rules amendment package was implemented in G.O. 09-06.
Of interest to practitioners, the most important question since "who killed Laura Palmer?" is now resolved - Local Rule CV-7(f) regarding reply and surreply briefs is amended to include cross references to Local Rule CV-6, which provides three extra days for service (similar to FRCP 6(d) but slightly broader).
Local Rule CV-30 was also amended to change the cite to FRCP 30(d)(1) to 30(c)(2) to reflect the new location of the relevant language after the recent style revisions of the FRCPs.
