Four stays issued in competency matters

By Howard Brooks Over the past week, the Nevada Supreme Court has issued four stays of proceedings in four cases involving competency issues. Right to Review Reports In State v. Christopher John Scarbo, District Court Case No. 240375, and State v. Scott David Roebke, District Court Case No. 240498, Judge Glass ruled that the Defense was not entitled to receive copies of the psych reports she relies upon in finding a client competent. To summarize how her proceedings work, counsel for Scarbo and Roebke informed lower courts that competency problems existed with the two clients. The lower courts immediately referred the matter to Judge Glass, who ordered psych evalus on the two defendants. No law or court rule authorizes this procedure...continue to full post
