Via Sentencing Law and Policy, Adam Liptak of the New York Times reports that Justice Samuel Alito is joining Justice Stevens in declining to participate in the US Supreme Court's "cert. pool." For almost 20 years, eight of the nine justices on the Supreme Court have assigned their law clerks to a shared legal pool that considers whether certiorari should be granted in incoming cases.

On Friday, June 13 at 1:30 p.m., the Nevada Supreme Court will hold a case management hearing to determine how best to address cases involving election matters. This type of hearing is unprecedented at the Nevada Supreme Court but is necessary so the Court can determine its schedules and so it can decide these cases by either the Primary Election or General Election deadlines for printing ballots.

I've been summoned to jury duty in federal court for a trial beginning on Wednesday, March 12. I imagine the odds are slim that I will be selected, but who knows as the attorneys may discover that I could be the ideal juror. I don't know if the case is criminal or civil, or if it will last a day or 8 weeks, or if I will be ousted as a potential juror within the first 5 minutes, but I do know that I am going to refrain from reading newspapers until my service is over so Harmful Error will be post-free until my return.

The case concerns a claim by the appellant that she should have been allowed to withdraw her plea of guilty where her plea agreement was not in Spanish and she did not speak English, her attorney did not personally review her plea agreement with her but instead relied upon a court interpreter to give advice about the plea agreement, and the interpreter provided erroneous advice about the immigration consequences of the plea.

The Nevada Commission on Judicial Discipline has filed an Answer to Judge Halverson's Emergency Petition for a Writ of Prohibition, or in the alternative a Writ of Mandamus. The Commission contends that it has not unnecessarily delayed the proceedings against Halverson, that it has conducted its investigative and adjudicative proceedings in a proper manner, and that Halverson has been afforded due process.

Halverson seeks stay

Judge Halverson has filed an emergency motion for stay of proceedings before the Nevada Commission on Judicial Discipline. She contends that all proceedings by the Commission should be stayed pending the Nevada Supreme Court's resolution of her petition for a writ of mandamus in which she challenges the Commission based upon its lengthy delay in filing formal charges against her.

Nevada Supreme Court orders answer from Judicial Discipline Commission

Today the Nevada Supreme Court entered an order compelling the Nevada Judicial Discipline Commission to file an answer to an emergency petition for a writ of mandamus filed by District Court Judge Halverson. In its order the Court directs the Judicial Discipline Commission to explain why it could not have filed a complaint against her in a timely manner and why its delay does not effectively constitute a removal from office.


Nevada Supreme Court issues first decision of the year

This morning the Nevada Supreme Court issued one decision: Lioce v. Cohen. The Court had previously issued an opinion in this case on December 28, 2006, but granted rehearing and substituted this new opinion. The case concerns attorney misconduct in closing arguments in a civil case, but is also worth review by those practicing criminal law.
