FL: Client's false identity has to be disclosed to the court

By John Wesley Hall, Jr.

ADVERTISEMENTS
In the Florida Bar News is this article: Client using an alias? It’s your duty to tell the court: An attorney representing a criminal defendant in court must tell the court if the defendant is using an assumed name, even if the client refuses to make the disclosure on his or her own. The Bar’s Professional Ethics Committee January 18 adopted a revised Ethics Opinion 90-6, which governs the duty of attorneys when they learn that their criminal clients are proceeding in court under false names. The client needs to be told that the lawyer cannot participate in a fraud on the court. The opinion is not on the FBN's website yet. 90-6 is not on the list either, probably because it has been revised.
