Summary Judgment Denied in Arava Case

According to Courthouse News Service, a federal judge in the United States District Court for the Southern District of New York denied the summary judgment motion filed by defendants Aventis Pharmaceuticals, Inc. and Sanofi-Aventis U.S., LLC.  In that action, plaintiff Louisiana-Wholesale Drug Company charged defendants with attempting to prevent the approval of a generic version of the arthritis drug leflunomide (Arava) through use of a sham Citizen-Petition with the U.S. Food and Drug Administration (FDA).  Judge Harold Baer’s Opinion and Order denying the summary judgment motion explains there are “genuine issues of fact with respect to the Defendants’ objective basis for filing the Petition.” The trial will commence on November 10, 2008.
