Are You in Good Company when you File a Bankruptcy in Arizona

By Joseph McDaniel, Esq.

ADVERTISEMENTS
Are other folks filing bankruptcy cases under Chapter 7, 13, 11, and 12 during the depression that grips the United States?

Well, yes. In huge, hockey-stick sorts of numbers. The Arizona Bankruptcy Court released numbers recently showing a huge spike in bankruptcy filings in the Phoenix Metro area.

That was not a surprise to any Arizona bankruptcy lawyer. All the attorneys who practice bankruptcy law in metropolitan Phoenix, whether in Chandler, Mesa, Scottsdale, Paradise Valley, Glendale, or Tempe (or Phoenix bankruptcy attorneys; don't wanna leave them out!) know perfectly well that filings are up.

Every month now feels like the day before the 2005 Amendments to the Bankruptcy Code went into effect, and that day was one to remember, as people filed bankruptcy in droves to avoid the Draconian effect of the BARF Act.

But something that makes me proud to be an Arizona Citizen is this: we don't hear about the possible benefits of filing a bankruptcy FOR Phoenix, or Scottsdale, or Mesa, or Chandler, or Gilbert, or Casa Grande, or Tempe, or...well, you get the idea.

In California, spirited discussions of a possible bankruptcy for Los Angeles continue.

I lived in Los Angeles for about a year when I was 18 years old; it was a wonderful city, and looked just like the TV shows about cops in Los Angeles, "Dragnet". When directors came to Los Angeles to film cinema noir, they complained that it was hard to find dirty and gritty areas to film there.

That's changed; I've been back working on cases there recently, and there is plenty of dirt and grit for the most serious cinema noir director in Los Angeles, now.

Progress is not always a wonderful thing. I'm proud that we in Arizona are not (currently) exploring bankruptcy options for our major cities. And I hope it stays that way.

And if you're feeling guilty because you planned and worked and saved and invested, and you got run over by a depression and you now have to file a bankruptcy, relax! It looks like you'll be in very good company before this depression is over.
